WIPO China: WIPO Arbitration and Mediation Shanghai Service Successfully Mediates Cross-Border Trademark Licensing Dispute

外国法的查明和适用一直是司法实践中的一个难点。根据中国相关法律规定，当事人可以协议选择知识产权转让和许可使用适用的法律；涉外民事关系适用的外国法律，由人民法院、仲裁机构或者行政机关查明；当事人提供外国法律的，应当提交该国法律的具体规定并说明获得途径、效力情况、与案件争议的关联性等；外国法律为判例法的，还应当提交判例全文。

Ascertaining and applying foreign law has long been a challenge in judicial practice. Under relevant Chinese law, parties may agree on the law applicable to the assignment and licensing of intellectual property rights. Foreign law applicable to civil relations involving a foreign element must be ascertained by the relevant people’s court, arbitral institution or administrative authority. A party submitting foreign law must provide its specific provisions and explain, among other matters, how those provisions were obtained, their legal validity and their relevance to the issues in dispute. Where the foreign law submitted takes the form of case law, the full text of the relevant judicial decisions must also be provided. 

鉴于外国法查明和适用的难点，法院在征得双方当事人同意后，将本案委托WIPO仲调上海中心调解。WIPO仲调上海中心指定了一名具有丰富涉外知识产权纠纷处理经验的专家，帮助双方当事人就许可协议解除及和解款数额等事项达成一致，并签署和解协议。双方均对调解结果表示满意，称赞WIPO仲调上海中心调解专业高效，降低了纠纷解决成本，帮助当事人圆满解决了争议。

Given the challenges of ascertaining and applying foreign law, the court referred the case to the WIPO Shanghai Service for mediation with the consent of both parties. The WIPO Shanghai Service appointed a mediator with extensive experience in handling foreign-related intellectual property disputes to conduct the mediation. With the mediator’s assistance, the parties reached agreement on matters including termination of the licensing agreement and the settlement amount, and signed a settlement agreement. Both parties expressed satisfaction with the outcome and praised the WIPO Shanghai Service for its efficiency and professionalism, stating that the mediation had helped reduce the costs of resolving the dispute and enabled the parties to reach a mutually satisfactory resolution.
